Plan, Protect, Provide

Most comprehensive estate plans include appropriate powers of attorney should an individual become incapacitated or otherwise unable to make medical and financial decisions. When these powers of attorney have not been established, family members and concerned friends can take legal action to establish a guardianship and conservatorship.

Defining Guardianships and Conservatorships

A guardianship gives a guardian the legal right to make important decisions on behalf of their charge. Many times, these types of decisions include arranging for medical treatment and for care to address an elderly person's daily living needs such as bathing, taking medications or getting appropriate nutrition.

A conservatorship allows a person to care for the financial affairs of someone who is unable to manage on his or her own. In addition to making sure bills are paid in the correct amount and on time, a conservatorship also protects an incapacitated person from being swindled and scammed.

Guardianships and Conservatorships are helpful at any age

Special needs children my require guardians throughout their lifetime to handle financial, educational and medical decisions for them. Adults may become incapacitated as the result of an injury or other tragic event, rendering it necessary to appoint someone to care for their finances and to make important decisions pertaining to their daily and medical care.
